What is an Expungement?

To œexpunge is to œerase or remove completely. In law, œexpungement is the process by which a record of criminal charges is sealed. An expungement order directs the court to treat the criminal charge as if it had never occurred, essentially removing it from your record as well as, ideally, the public record. Just a few years ago, the legislature and the governor passed the Second Chance Act, which grants the court the authority to expunge many criminal cases that were not previously eligible. Most misdemeanor and gross misdemeanor offenses can be expunged if enough time has passed and you have not been convicted of a new offense. Even some felonies are eligible for expungement.

In order to properly expunge a previous conviction, there are many steps to take. Before you can even get a court date, a persuasive petition needs to be drafted. It next needs to be filed with the court and served on the appropriate government agencies that have your records. The list of state agencies with a record of your conviction can be long. How Long Will it Take to Expunge My Record?

The expungement process is anything but fast. Most expungements take more than six months to finalize. The current crisis has also put stress on the court system and there is likely to be a log jam of cases once the courts open back up. § For most cases you will be required to pay a court filing fee in the range of $300.00.

§ The expungement court process is lengthy. It will take at minimum six months to reach a final outcome.

§ Even if you a preliminarily determined eligible for the program, an attorney/client relationship shall not be established until a retainer agreement has been executed by both parties.
